1. Agreement to Terms
By accessing or using the CCfamily Communications website, member portal, or any of our IT services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These terms apply to all visitors, clients, and members who access or use our services.
2. Description of Services
CCfamily Communications provides enterprise IT solutions including but not limited to:
- Network engineering and infrastructure
- Cybersecurity services and assessments
- Cloud solutions and migration
- IT support and help desk services
- Remote support via Zoho Assist
- Infrastructure cabling and installation
- IT consulting and strategic planning
- Member portal access (affiliate links, tools, resources)
3. Member Portal
Account Registration
To access the member portal, you must create an account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
Affiliate Links
The member portal contains affiliate links to third-party products and services. These are products we personally use and recommend. When you use these links:
- CCfamily Communications may earn a commission at no additional cost to you
- Your relationship with the third-party provider is governed by their own terms
- We are not responsible for third-party products, services, or their terms
- Affiliate relationships do not influence our recommendations
4. Remote Support Sessions
When you use our remote support service:
- You must explicitly grant permission for each session
- You maintain full control of your device at all times
- You may end the session at any time by closing the window or disconnecting
- Sessions are encrypted end-to-end via Zoho Assist
- Session logs may be retained for 30 days for quality assurance
- You agree not to use remote support for any illegal purpose
5. Service Agreements
Specific IT services may be governed by separate service agreements, statements of work, or service level agreements (SLAs). In the event of a conflict between these Terms of Service and a specific service agreement, the service agreement shall prevail.
6. Payment Terms
- Payment Processing: All payments are processed securely through Stripe.
- Invoicing: Invoices are issued at the beginning of each service period.
- Payment Due Date: Payment is due within 30 days of invoice date unless otherwise specified.
- Late Payments: Overdue payments may incur a 1.5% monthly late fee.
- Subscription Services: Recurring services are billed monthly. You may cancel at any time with 30 days written notice.
7. Intellectual Property
All content, features, and functionality of the CCfamily Communications website and portal — including but not limited to text, graphics, logos, icons, images, audio clips, software, and their compilation — are the exclusive property of CCfamily Communications and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute any content from our website without written permission
- Use our trademarks, logos, or branding without authorization
- Scrape, extract, or collect data from our website through automated means
- Reverse engineer any software or tools provided through our services
8. Limitation of Liability
To the maximum extent permitted by law:
- CCfamily Communications shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
- Our total liability for any claim arising from these terms or our services shall not exceed the total amount you paid us in the 12 months preceding the claim.
- We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, or third-party service failures.
9. Indemnification
You agree to indemnify and hold harmless CCfamily Communications, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our services
- Your violation of these Terms of Service
- Your violation of any applicable law or regulation
- Any content you submit or transmit through our services
10. Warranties Disclaimer
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- Our services will be uninterrupted, timely, secure, or error-free
- The results obtained from our services will be accurate or reliable
- Any defects in our services will be corrected
11. Force Majeure
Neither party shall be liable for any failure or delay in performing obligations due to causes beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, power outages, internet disruptions, or failures of third-party services or platforms on which our services depend.
12. Termination
We may terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason we deem appropriate.
You may terminate your account at any time by contacting us. Upon termination:
- Your right to use our services will immediately cease
- We will delete your account data within 30 days, subject to legal retention requirements
- Outstanding payment obligations survive termination
13. Dispute Resolution
Informal Resolution
Before filing any formal legal claim, you agree to first contact us at support@ccfamily.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
Arbitration
If the dispute is not resolved informally, you agree to resolve the dispute through binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures. The arbitration will be conducted in Alameda County, California. The arbitrator's decision is final and binding.
Exceptions
Either party may seek injunctive relief in any court of competent jurisdiction for matters related to intellectual property rights or unauthorized access to our systems.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
15. Modifications
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on our website. Your continued use of our services after modifications constitutes acceptance of the updated terms.
16. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and CCfamily Communications regarding the use of our services, superseding any prior agreements.
